Terms & Conditions


1. GENERAL
This Refund, Returns, Cancellation and Risk Policy (“Policy”) applies to all purchases made from ProBuild Hardware Ermelo (“ProBuild”, “we”, “us”, or “our”), whether in-store, telephonically, electronically, or through any online platform operated by ProBuild.
By purchasing Products from ProBuild, the customer (“you” or “your”) agrees to be bound by this Policy, subject to the provisions of the Consumer Protection Act 68 of 2008 (“CPA”) and all applicable South African laws.

2. CANCELLATION OF ORDERS
2.1 Customers may cancel an order by contacting ProBuild Hardware Ermelo directly through our Customer Service Department or the branch where the order was placed.
2.2 Orders may only be cancelled prior to dispatch, collection, cutting, mixing, manufacturing, special ordering, or delivery preparation of the Products.
2.3 Cancellation requests received after Products have been dispatched, specially ordered, cut to size, mixed, tinted, manufactured, or prepared for delivery may be subject to a reasonable cancellation fee in accordance with the CPA.
2.4 Delivery charges already incurred by ProBuild may be deducted from any refund amount.
2.5 Where payment has already been processed, refunds arising from cancellations will be processed in accordance with this Policy.
2.6 ProBuild reserves the right to cancel any order where:
  • payment has not been successfully received;
  • incorrect pricing or stock information was displayed;
  • Products are unavailable;
  • fraud or unlawful activity is suspected; or
  • the customer breaches any applicable terms or conditions.
2.7 If a customer reverses, disputes, or cancels payment without lawful grounds after an order has been processed, the customer remains liable for the full purchase price and any costs incurred by ProBuild in recovering such amounts.

3. RETURNS POLICY
3.1 Customers may return eligible Products to ProBuild Hardware Ermelo subject to the following conditions:
  • the Product must be returned within a reasonable period;
  • the Product must be accompanied by the original invoice, till slip, or proof of purchase;
  • the Product must be unused, undamaged, and in its original packaging where reasonably possible;
  • all accessories, manuals, and components must accompany the returned Product.
3.2 The following Products may not be eligible for return unless defective or required by law:
  • specially ordered items;
  • cut-to-size materials;
  • mixed paint or tinted products;
  • cement or products affected by moisture;
  • installed or used Products;
  • damaged Products caused by misuse, negligence, or improper handling.
3.3 Returns may be inspected by ProBuild prior to approval of any refund, repair, replacement, or exchange.
3.4 ProBuild reserves the right to refuse returns that do not comply with this Policy or the CPA.

4. DEFECTIVE OR DAMAGED PRODUCTS
4.1 Customers are encouraged to inspect all Products upon collection or delivery.
4.2 If a Product is defective, damaged, incomplete, or materially incorrect, the customer must notify ProBuild as soon as reasonably possible.
4.3 In accordance with the CPA, customers may be entitled to repair, replacement, or refund where Products are defective or fail to meet acceptable quality standards.
4.4 ProBuild may require reasonable proof of the defect before processing a claim.

5. REFUNDS
5.1 Approved refunds will be processed for the amount paid by the customer less:
  • delivery costs already incurred;
  • applicable cancellation fees permitted by law;
  • costs associated with damaged or missing packaging or components where applicable.
5.2 Refunds will be processed using the original payment method wherever reasonably possible, including:
  • cash purchases refunded in cash (subject to cash handling limits);
  • card payments refunded to the original card;
  • EFT payments refunded to the originating bank account;
  • trade account payments credited back to the applicable account.
5.3 EFT refunds are subject to banking verification procedures.
5.4 Refund processing may take up to 7 (seven) business days depending on banking institutions and verification requirements.
5.5 ProBuild reserves the right, at its discretion and subject to applicable law, to limit cash refunds.

6. WARRANTIES AND LIMITATION OF LIABILITY
6.1 To the fullest extent permitted by law, ProBuild makes no representations or warranties other than those expressly required under the CPA or provided by manufacturers.
6.2 Product specifications, availability, pricing, and information are subject to change without notice.
6.3 Customers acknowledge that:
  • Product selection and suitability remain the responsibility of the customer;
  • any reliance on advice or recommendations is at the customer’s own risk unless otherwise required by law.
6.4 ProBuild shall not be liable for any indirect, consequential, incidental, or special damages arising from:
  • misuse of Products;
  • incorrect installation;
  • delays in delivery;
  • supplier shortages;
  • interruptions beyond ProBuild’s reasonable control;
  • loss of profits, business, or opportunity.
6.5 Nothing in this Policy excludes or limits any rights which cannot lawfully be excluded under the CPA.

7. INDEMNITY
7.1 Customers indemnify and hold harmless ProBuild Hardware Ermelo, its directors, employees, agents, contractors, and representatives against any claims, damages, losses, or liabilities arising from:
  • misuse of Products;
  • failure to follow instructions or safety guidelines;
  • negligent handling or installation of Products;
  • breach of this Policy or applicable laws by the customer.
8. RISK AND OWNERSHIP
8.1 Risk in the Products passes to the customer upon:
  • collection by the customer or their authorised representative; or
  • delivery and offloading at the customer’s nominated delivery address.
8.2 Ownership of Products shall remain vested in ProBuild until full payment has been received and cleared.
8.3 Customers must inspect Products immediately upon collection or delivery and report shortages or visible damage without delay.

9. DELIVERY
9.1 Delivery dates and times are estimates only and may vary due to operational requirements, supplier delays, traffic, weather conditions, or circumstances beyond ProBuild’s control.
9.2 ProBuild shall not be liable for losses arising from delayed deliveries.
9.3 Customers must ensure safe and reasonable access for delivery vehicles.

10. GOVERNING LAW
This Policy shall be governed by and interpreted in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008.
